QldParks-Wifi Terms and Conditions of Use
These terms and conditions apply to your access to, and use of, the department's free Wi-Fi hotspot in national parks (‘QldParks-Wifi’). Access to QldParks-Wifi is subject to these terms and conditions, which may be revised, modified or updated by the department at any time without further notice to you. You should therefore check these terms and conditions from time to time so that you are aware of any changes. By continuing to access and use QldParks-Wifi following any changes to the terms and conditions, you accept and agree to comply with the terms and conditions, as amended.
If you do not agree to comply with these terms and conditions, you must not access or use QldParks-Wifi. If the department believes that you have breached any of these terms and conditions, your access will be terminated and you will be automatically logged out of QldParks-Wifi.
In these terms and conditions “you” or “your” means the individual using or seeking to access and use QldParks-Wifi.
Connecting to and termination of connection to QldParks-Wifi
In order to use QldParks-Wifi, you need a wireless enabled device with an ability to use a web browser.
Your access may be terminated and you may be automatically logged out of QldParks-Wifi at any time if:
a. You breach any of these terms and conditions;
b. The wireless connection to QldParks-Wifi is lost, becomes out of range or for any other reason is disconnected.
c. No activity is detected from your wireless enabled device for a period of time determined by the department in its entire discretion.
d. You exceed a download limit as determined by the department in its entire discretion.
Intellectual property rights
QldParks-Wifi, the login or splash page for QldParks-Wifi, the department’s webpages and these terms and conditions may contain material which is owned by or licensed to the department. This material includes, but is not limited to, the design, layout, look, appearance, graphics and any documents or other content on or accessed through those web pages which is protected by intellectual property laws, including, copyright.
You may view, use and download content on the above mentioned web pages for personal and research use only.
No guarantees as to security and reliability
The department does not guarantee that access will always be available or that QldParks-Wifi will be free from errors, viruses, interception or interference. The department accepts no responsibility for and will not be liable for any loss or damage sustained in connection with your access to and use of QldParks-Wifi.
The department is not responsible for the content of any website accessed or used via QldParks-Wifi and your access to and use of any website or network connection whilst using QldParks-Wifi is entirely at your own risk.
Your inability to access QldParks-Wifi for any reason (including that it is unavailable or the connection fails) does not excuse you from any requirement to obtain a permit, licence or other authorisation or make a site or service booking in relation to access to and use of a national park.
Your obligations
QldParks-Wifi is provided free of charge for purposes including accessing the internet to explore Queensland's national parks online, planning your visit or checking road conditions and local weather. You must not use QldParks-Wifi for purposes which include the following:
a. Use that could breach any law or cause the department to breach any law;
b. Use that could cause the department to incur any liability to a third party;
c. Use that could interfere with the integrity or performance of QldParks-Wifi;
d. Use that promotes any form of criminal activity, racism, bigotry, hatred or physical harm to any group or individual;
e. Access to adult content or to websites which contain or depict nudity, violence or offensive subject matter; or
f. Credit card purchases.
The department may, in its absolute discretion, block or limit access to websites via QldParks-Wifi. The department reserves the right to monitor or filter the traffic on QldParks-Wifi for the purposes of monitoring compliance with these terms and conditions.
Liability
The department will not in any circumstances (including for negligence) be liable for any loss of revenue, loss of profit, loss of anticipated savings or business losses, loss of opportunity, loss of data or goodwill, loss of reputation, or any indirect or consequential loss, whether arising in contract, tort (including negligence) or otherwise, in connection with your access to and use of QldParks-Wifi.
Release and indemnity
You release and discharge to the full extent permitted by law the department (including employees, contractors and agents of the department) from any liability, claim, demand, action, suit or proceeding which may be brought against or made upon the department in connection with your use of QldParks-Wifi, including in connection with a breach of the terms and conditions by you.
You agree to indemnify the department, its employees, contractors and agents, from and against all loss (including reasonable legal costs and expenses), damage, liability, charge, expense, cost and proceeding that may be made or brought by any person against the department in connection with your access to and use of QldParks-Wifi or in connection with a breach of these terms and conditions by you.
Privacy
The department must comply with the Information Privacy Act2009 (Qld) (IPA) in relation to your personal information. Any personal information you provide will be treated in accordance with department’s Privacy Statement.
General
You must not assign, sublicense or otherwise deal in any way with any of your rights under these terms and conditions.
If a provision of these terms and conditions is invalid or unenforceable it is to be read down or severed to the extent necessary without affecting the validity or enforceability of the remaining provisions.
These terms and conditions will terminate if, for any reason, we cease providing QldParks-Wifi.
Termination, for any reason, will not end those provisions that are capable of surviving termination.
Your access to QldParks-Wifi and these terms and conditions are governed by Queensland law.
